United States Fourth Circuit

US v. Bennett, 11-4401

Defendant's sentence for parole violations is affirmed where: 1) Tapia v. US applies to resentencing on revocation of supervised release in addition to the context addressed by Tapia itself; and 2) defendant has failed to show that the district court's putative Tapia error affected his substantial rights by influencing the outcome of the sentencing proceeding.
