Defendant's conviction for embezzlement by a bank employee in violation of 18 U.S.C. section 656, following a guilty plea is vacated and a petition for writ of error coram nobis claiming ineffective assistance of counsel is granted, as defendant has met his burden under prong two of Strickland that his counsel's affirmative misrepresentations that the crime was non-deportable prejudiced the defendant, and he has also demonstrated that he has suffered a fundamental error necessitating coram nobis relief.
