US v. Davis, 11-6301

Defendant's conviction for possession of a firearm by a convicted felon following a guilty plea and a mandatory minimum sentence under the Armed Career Criminal Act (ACCA), are affirmed, as although defendant's appeal waiver cannot be enforced because he did not knowingly and intelligently waived the right to appeal his mandatory his sentence as he was repeatedly advised incorrectly that he faced a maximum sentence of only ten years, defendant's cialms regarding the district court's conclusion that he was an armed career criminal are meritless nonetheless.
