United States Fourth Circuit
US v. Worley, 11-4348
In a conviction for drug related charges, defendant's sentence is affirmed in part, reversed in part, vacated in part and remanded where: 1) district court's imposition of federal tier II sex offender conditions based on defendant's prior record as a sex offender is reversed as the court plainly erred in imposing restrictive conditions based on sex offenses, and not drug-related offenses; 2) remaining conditions that do not infringe upon defendant's relationship with his children and girlfriend are vacated and remanded; and 3) imposition of a 100 month sentence is affirmed as it was procedurally and substantively reasonable.
