United States Fourth Circuit
US v. Darrin Davis, 10-5234
A sentence is affirmed, as it was proper for the district court to consider sentencing factors other than the defendant's substantial cooperation with police when determining the extent of the sentence reduction pursuant to Rule 35(b), since: 1) nothing in the plain language of Rule 35(b) prohibits such consideration; and 2) it is consistent with the broad discretion afforded to the district court during sentencing.
