United States Fourth Circuit

US v. Laudermilt, 11-4624

In a prosecution for possession of a firearm after a felony conviction, the district court's grant of a motion to suppress the firearm is reversed, where the police officers' actions were consistent with the Fourth Amendment, since in a threatening domestic situation, with information that at least a special needs child was in the home, they conducted a properly circumscribed protective sweep, which yielded the discovery of a firearm as that sweep continued.
