US v. McBride, 10-5162
In a prosection for possession of cocaine with intent to distribute, being a felon in possession of a firearm, and knowingly using and carrying a firearm in furtherance of a drug trafficking crime, the convictions are: 1) affirmed in part, where a) police officers' detention of the defendant's car was supported by reasonable, articulable suspicion, and b) the 55-minute period between the beginning of the detention and the arrival of the canine narcotics unit did not result in an unlawful seizure of the car; and 2) reversed as to two of the three counts, where the admission of prior "bad act" evidence was error, and its admission was not harmless.
