US v. Lam, 11-4056
In a prosecution for conspiracy to traffic in counterfeit goods, trafficking in counterfeit goods, and smuggling goods into the United States arising out of the defendants' participation in the manufacture, import, and sale of handbags and wallets bearing counterfeit trademarks, convictions are affirmed, where: 1) the evidence presented at trial was sufficient to allow a jury to conclude that the mark displayed on the defendants' goods was a counterfeit and that the defendants knew it was a counterfeit; 2) there was no plain error in a jury instruction; 3) the trafficking statute, 18 USC section 2320(a), is not unconstitutionally vague; and 4) curative instructions after the government's allegedly improper comments at trial were sufficient to ensure the defendants were afforded a fair trial.
