Rosetta Stone Ltd v. Google, Inc., 10-2007
In a suit bringing trademark infringement claims and an unjust enrichment claim against Google stemming from its policy permitting advertisers to use the plaintiff's marks as keywords in the AdWords program and to use the plaintiff's marks in the text of advertisements: 1) summary judgment to Google on the vicarious infringement claim is affirmed; 2) the district court's order granting summary judgment to Google on the direct infringement, contributory infringement and dilution claims is vacated; and 3) the district court's order dismissing the unjust enrichment claim is affirmed.
