Epps v. JP Morgan Chase Bank, N.A., 10-2444

In a suit brought against an assignee bank pursuant to the Maryland Credit Grantor Closed End Credit Provisions (CLEC), the district court's judgment granting the bank's motion to dismiss is vacated, where: 1) the district court erred in concluding that the CLEC was preempted by the National Bank Act or regulations of the Office of the Comptroller of the Currency; and 2) the district court erred in dismissing the plaintiff's breach of contract claim.
