US v. Thornsbury, 11-7109

In a case in which the defendant pleaded guilty to being a felon in possession of ammunition and waived his right to appeal "any sentence," and the government subsequently moved to reduce his sentence in light of his assistance in prosecuting an unrelated case, the defendant's appeal of the district court's denial of the motion is dismissed, where: 1) the Fourth Circuit had jurisdiction to hear the defendant's appeal pursuant to 18 USC section 3742(a)(1); but 2) the defendant's waiver was valid; and 3) the appeal was within the scope of the waiver.
