US v. White, 10-4241

In a prosecution of the "Commander" of the American National Socialist Workers' Party, the Fourth Circuit: 1) affirms the district court's rulings on a Rule 29 motion for acquittal on charges of violating 18 USC section 875(c), which criminalizes the interstate transmission of "any threat to injure the person of another"; and 2) vacates the sentence and remands for resentencing because the district court applied an incorrect standard in deciding whether to consider an enhancement for victims' vulnerability.
