In an action by a seller of land seeking to enforce a restrictive covenant in a deed, the district court's order granting summary judgment to the buyer is reversed and its fee award vacated, where the district court erred in finding the covenant overbroad and unenforceable, in that there was error in interpreting the covenant to include an asserted impermissible restriction, and the covenant afforded a fair protection to the seller's interests without being so large as to interfere with the interests of the public.
