US v. Gaines, 11-4032
In a prosecution for possession of a firearm by a convicted felon in which the defendant moved to suppress--as "fruit of the poisonous tree"--a firearm seized by police following an unlawful stop of a vehicle in which he was a passenger, the district court's order granting the motion is affirmed, as the defendant's assault on the police officers after the stop did not purge the taint of the unlawful stop.
