US v. Jaensch, 10-5013
Conviction and sentencing of defendant for using false diplomatic credentials in violation of 18 U.S.C. section 1028(a)(1) are upheld where: 1) Section 1028(a)(1) is not unconstitutionally vague; 2) the district court correctly instructed the jury that it could use a reasonable person standard" to determine whether the credentials "appeared to be" government-issued; 3) sufficient evidence supports conviction; and 4) the indictment was not defective because it failed to separately charge defendant with "aiding and abetting" in violation of 18 U.S.C. section 2(b).
