Kunda v. C.R. Bard, Inc., 09-1809

In an appeal from a rule 12(b)(6) dismissal of plaintiff's employment action, judgment is affirmed where the court correctly held that: 1) New Jersey law applies to subject plan agreement because the Maryland Wage Payment and Collection Law (MWPCL) is not a fundamental public policy of Maryland; and 2) certain unvested shares are not wages under the MWPCL and thus were never owed to plaintiff.
