US v. Hill, 10-4320
Plea conviction and sentencing of defendant for possession of cocaine base with intent to distribute, 21 U.S.C. section 841(a), are vacated where the judgment of district court denying defendant's motion to suppress is reversed because while a subsequent consent to search defendant's residence was valid, the police's initial, warrantless entry was invalid such that the court needed to determine whether the consent was sufficient to dissipate the taint from the initial illegal search.
