Priestley v. Astrue, 10-1113
In a dispute arising from petitioners' motion for fees and cost as prevailing parties in an appeal from the Social Security Administration’s denial of their claims for disability benefits, Equal Access to Justice Act (EAJA), 28 U.S.C. section 2412(d), judgment of the district court is affirmed in part where it properly awarded cost to a domestic attorney but reversed as erroneous where it denied fees to out-of-state attorneys on the grounds that the lack of licensure was a special circumstance that made reimbursement of their fees unjust under the EAJA.
