Boyd v. Metropolitan Life Ins. Com., 10-1702

In an ERISA dispute involving the validity of payment to an expressed beneficiary-spouse who, at the time of the death of the policy holder, was separated and had waived his beneficiary interest, dismissal of the trial court is affirmed where defendant fulfilled its statutory duty under ERISA and action is foreclosed by recent US Supreme Court decision in Kennedy v. Plan Administrator for DuPont Savings & Investment Plan, 129 S. Ct. 865 (2009).
