Brockington v. Boykins, 09-2308
In a 42 U.S.C. section 1983 dispute alleging the use of excessive, deadly force by a police officer, denial of motion to dismiss on the ground of qualified immunity is affirmed where a reasonable officer would have recognized that deadly force was no longer needed after plaintiff was injured and helpless.
