Brandt v. Gooding, 09-7907

Conviction and sentence for criminal contempt action for introducing a fraudulent letter into deposition in an underlying legal malpractice suit brought in state court by petitioner against an attorney and her law firm after she represented petitioner in the closing of a real estate transaction, the district court's grant of summary judgment in petitioner's favor is affirmed where: 1) it is undisputed that the state court failed to provide with notice of the criminal contempt charge before the hearing in which that charge was adjudicated; and 2) the district court did not err in denying attorney's motion to intervene.
