Barbour v. Int'l Union, 08-1740

In a suit by former employees of Chrysler against several labor unions alleging state claims of negligent misrepresentation, which was removed to federal court by UAW, the district court erred when it denied the plaintiffs' motion to remand to state court, because the UAW’s notice of removal was untimely filed. Accordingly, district court's judgment is vacated and remand the case to the district court with instructions to remand the case to Maryland state court.
