United States Fourth Circuit

US v. Wiliams, 09-4049

Conviction of defendant for conspiracy to possess with intent to distribute heroin is vacated and remanded as, the district court abused its discretion by admitting the stipulation into evidence over defendant's objection because it violated his right to confront witnesses under the Sixth Amendment, and this prejudice alone is enough to require that the conviction be vacated.
