Brown v. N. Carolina Dep't of Corr., 08-8501
In a suit under 42 U.S.C. section 1983 alleging that defendants-correctional officers were deliberately indifferent to the serious harm he suffered at the hands of a fellow inmate, dismissal of the complaint for failure to state a claim upon which relief may be granted is vacated and remanded where the complaint states facts sufficient to state a plausible claim.
