US v. Claridy, 08-5025
A conviction for drug and firearm related offenses is affirmed where: 1) under the circumstances in this case, Federal Rule of Criminal Procedure 41 did not govern the search warrant challenged by defendant; 2) even if Rule 41 did apply, defendant was not prejudiced by the claimed violation and therefore would not have been entitled to suppression of the evidence seized during the search; and 3) an argument that defendant's inculpating statement was made after an unreasonable delay after his arrest was unsupported by the evidence.
