US v. Green, 08-4088
Conviction of defendants for drug related crimes involving a family-based drug distribution network are affirmed where: 1) the evidence was sufficient to support the defendants' convictions beyond a reasonable doubt; 2) district court did not err in denying the motions for judgment of acquittal; 3) district court did not clearly err in finding that a search of a defendant's residence, and the area under the bed in particular, was a permissible protective sweep intended to safeguard the officers effecting the arrest; 4) the district court correctly applied the plain view exception to the Fourth Circuit warrant requirement; and 5) there is no abuse of discretion or error of law in respect to the district court's rulings in the management of the proceedings below.
