US v. Purdue Pharma L.P., 09-1202

In plaintiff's qui tam action alleging that his former employer defrauded the government by marketing its pain-relief drug, OxyContin, as a cheaper alternative to another drug, district court's dismissal of the suit and denying plaintiff's leave to file a Fifth Amended Complaint is affirmed although the circuit court finds the district court erred in its decision not to enforce a release as a bar to plaintiff's claims because the allegations of fraud were sufficiently disclosed to the government prior to plaintiff's filing of the qui tam suit.
