In a suit brought against federal and state agencies alleging violations of the National Environmental Policy Act (NEPA), denial of defendant-Director of South Carolina Department of Transportation's (Director) motion to dismiss plaintiff's complaint is affirmed where: 1) the district court properly found that plaintiff stated a cause of action for prospective relief under NEPA; and 2) the Director was party to the suit.
