In claim by Nigerian citizen-petitioner contending his eligibility to adjust his status without leaving the U.S. because he is a "grandfathered alien" who was the beneficiary of a special immigrant visa petition filed before April 30, 2001, petition to review decision ordering petitioner's voluntary departure and dismissing his appeal is denied where: 1) the visa petition by which petitioner relied was not "approvable when filed; and 2) court finds no error in Board of Immigration Appeals decision.
