US v. Beasley, 04-4107

Conviction and sentence for conspiracy to distribute crack cocaine and possession with intent to distribute crack cocaine are affirmed over claims that the district court erred in: 1) relying on enhanced penalties provided by 21 U.S.C. section 841(b)(1)(B) for repeat drug offenders as the government did not provide him with timely notice of its intent to rely on his prior convictions to request increased punishment; and 2) two of its evidentiary rulings.
