US v. Allen, 05-5249

Convictions and sentence for wire fraud are affirmed over defendants' arguments that: 1) there was insufficient evidence to sustain their convictions; 2) the district court improperly instructed the jury on the mens rea requirement of wire fraud; 3) the admission of evidence provided by one defendant incriminated the other and violated his rights under Bruton v. US; 4) the district court abused its discretion by denying one defendant's motions for severance and a mistrial; 5) the action of the district court, the prosecution and defense counsel violated their Sixth Amendment rights; and 6) the district court committed numerous errors in calculating a defendant's sentence.
