United States Fourth Circuit

Valley Historic Ltd P'ship v. Bank of N.Y., 06-1571

In case involving Chapter 11 debtor, district court's determination that the bankruptcy court lacked jurisdiction over the debtor's post-confirmation adversary proceeding for breach of contract and for tortious interference is affirmed. However, the district court's decisions regarding the debtor's claims are vacated as, without subject matter jurisdiction over the adversary proceeding, neither the bankruptcy court nor the district court had jurisdiction to determine these additional issues.
