Sciolino v. City of Newport News, 05-2229
In suit brought by former probationary city police officer alleging false information was placed in his personnel file when he was discharged, dismissal of complaint is vacated. The district court abused its discretion in denying plaintiff's motion to amend complaint to meet standard of alleging facts asserting a likelihood that prospective employers or members of the public would see the damaging information.
