Nigh v. Koons Buick Pontiac GMC, Inc., 05-2059

In protracted litigation over Truth in Lending Act and consumer protection claims, including a decision from the U.S. Supreme Court on a statutory damage cap, an order awarding attorney fees to plaintiff is affirmed as plaintiff was successful in his TILA action. However, the award is vacated as to attorney fees incurred prior to the initial 4th Circuit appeal where the trial court likely committed an error in transcription and must recalculate the award on remand.
