United States Fourth Circuit

Int'l Ground Transp., Inc. v. Mayor and City Council of Ocean City, 05-1827

Judgment as a matter of law for all defendants, entered by trial court on motion after jury found defendant-city liable in case alleging plaintiff taxicab business was damaged by unconstitutional acts by defendants, is reversed as to the entry of JMOL in favor of city, as neither of the two possible bases on which the city could have relied supports a finding that the jury's verdict is legally unsound.
