ABT Building Products Corp. v. National Union Fire Ins. Co., 05-1739
Judgment against defendant and awarding plaintiffs compensatory damages for defendant's breach of its duty to defend, declaratory relief on its indemnity obligations, treble damages under the North Carolina Unfair and Deceptive Trade Practices Act, and attorney fees, is affirmed over claims that the district court erred in failing to grant judgment as a matter of law on: 1) breach of duty to defend claim; 2) obligation to indemnify claim; 3) claim that defendant had violated the UDTPA; and 4) erred in awarding attorney fees to plaintiff.
