Kloth v. Microsoft Corp, 04-2566

Dismissal of claims of 26 plaintiffs is affirmed where plaintiffs: 1) were indirect purchasers of defendant's software and were barred from seeking recovery for illegal pass-through overcharges; 2) lacked standing to seek recovery because they failed to demonstrate a direct antitrust-type injury; and 3) where the district court did not abuse its discretion in applying the doctrine of laches to dismiss equitable claims.
