Hazelbaker v. Hope Gas, Inc., 04-2526

Dismissal, based on "statutory mootness," of appeal challenging bankruptcy court's authorization of assumption and sale of oil and gas lease is affirmed where plaintiff failed to obtain a stay pending appeal, and to enforce 11 U.S.C. section 363(m)'s express concern with the finality of bankruptcy sales.
