Wilson v. Draper & Goldberg, P.L.L.C., 05-1392

Grant of summary judgment in favor of defendants, a law firm and one of its lawyers, in a case alleging violation of the Fair Debt Collection Practices Act is reversed where a foreclosure action by defendants was an attempt to collect a "debt," defendants were not excluded from the statutory definition of "debt collector," and they could still be "debt collectors" even if they were also enforcing a security interest.
