Partington v. American Int'l Specialty Lines Ins. Co., 04-2279
District court's holdings, that default judgment obtained against a provider of trustee service was void and that the judgment in favor of plaintiff was unenforceable, are vacated where the lower court had subject matter jurisdiction to enter the default, and although the district court entered judgment against a putative class that plaintiff was a part of, plaintiff could still enforce the default judgment.
