Dismissal of a wrongful death action on statute of limitations grounds as a dismissal "without prejudice" is affirmed where the district court retained subject matter jurisdiction over the action, and did not abuse its discretion under the circumstances in dismissing the action without prejudice or by setting aside certain default judgments.
