US v. JOHNSON, 02-4413

Upon the government's motion for a downward departure pursuant to 18 U.S.C. section 3553(e), a district court can impose a sentence below the Guideline range even though the defendant is subject to a statutory minimum sentence that exceeds the Guideline range.
