United States Fourth Circuit

US v. EALY, 02-4901

The five-year statute of limitations generally applicable to non-capital offenses does not bar this multi-count murder prosecution. The limitations period depends on the capital nature of the crime, not on whether the death penalty is in fact available for defendants in a particular case.
