E. TENNESSEE NATURAL GAS CO. v. SAGE, 03-1708/1741, 03-1797
Once a district court determines that a gas company has the substantive right to condemn property under the Natural Gas Act, the court may use its equitable power to grant the remedy of immediate possession through the issuance of a preliminary injunction. Injunctive relief was properly granted to plaintiff in these cases, arising from its plan to construct an interstate gas pipeline.
