United States Fourth Circuit

S. ATLANTIC LTD. P'SHIP OF TENNESSEE, LP v. RIESE, 02-2274

Post-mandate judgment entered by the district court in 2002 modified the circuit court's 1999 judgment in contravention of the mandate rule. In specifying how the Unfair Trade Practices Act award should be allocated between defendants, the post-mandate judgment foreclosed all possible allocation scenarios save one, thereby altering the prior judgment.
