United States Fourth Circuit
U.S. DEPT. OF HEALTH & HUMAN SERV. CORP. v. SMITLEY, 02-2056
In a Chapter 7 case, the district court's order affirming the bankruptcy court's discharge of defendant's Health Education Assistance Loans (HEAL loans) is reversed where the district court erred in holding that nondischarge of the HEAL loans would be unconscionable under 42 U.S.C.A. section 292f(g).
