United States Fourth Circuit

US v. SAYLES, 00-4833/59

Court did not err in permitting a co-conspirator to invoke the Fifth Amendment privilege, allowing the co-conspirator to avoid testifying on defendant's behalf; the total absence of evidence as to defendants' aggravating role in a drug conspiracy made sentence enhancements under U.S.S.G. section 3B1.1. clearly erroneous.
