United States Fourth Circuit

BOULWARE v. CROSSLAND MORTGAGE CORP., 01-2318

Real Estate Settlement Procedures Act section 8(b) is a prohibition on kickbacks, rather than a broad price control provision applicable to any overcharge for real estate settlement services; denial of class certification and dismissal of complaint alleging overcharge for credit reports were proper.
