United States Fourth Circuit

NATIONAL HOME EQUITY MORTGAGE ASS-N v. FACE, 01-1631

Once the district court found that the plaintiff had a federally enforceable right under the Parity Act, it correctly determined that the plaintiff prevailed on that right through a 42 U.S.C. section 1983 claim and, thus, the plaintiff was entitled to its award of attorneys fees, costs, and expenses under section 1988.
