LAWYERS TITLE INS. CORP. v. REX TITLE CORP., 01-2011

Although Maryland law does not permit an insurance company that has entered into an agency contract with an insurance agent to assert a claim of negligence against the agent, Maryland does recognize an independent duty of care owed by an insurance agent to its principal, the breach of which gives rise to a cause of action for negligence.
